Welcome to McCartney Marketing LLC. These Terms of Service ("Terms") govern your use of www.mrsmichellemccartney.com, The Mompreneur Club community, our courses, coaching programs, lead magnets, and any other products or services we offer (together, the "Services").

By accessing our website, opting in to our email list, purchasing a product, or joining our community, you agree to these Terms. If you do not agree, please do not use the Services.

In these Terms, "we," "us," and "our" refer to McCartney Marketing LLC. "You" and "your" refer to the person accessing the Services.

1. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to use the Services. By using the Services, you confirm that you meet these requirements.

2. Account Registration and Community Access

Some Services require you to create an account through Skool or another platform we use. You agree to:

Provide accurate, current, and complete information when you register.

Keep your login credentials confidential and not share them with anyone else.

Be responsible for all activity that occurs under your account.

Notify us immediately if you suspect unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms or our community rules.

3. Purchases, Subscriptions, and Payment

Pricing

Current pricing for The Mompreneur Club and other paid Services is displayed at the point of purchase. We may change prices at any time, but changes will not affect purchases you have already made.

Subscriptions and Renewals

Paid memberships in The Mompreneur Club are sold as either monthly or annual subscriptions. By subscribing, you authorize us (through our payment processor) to charge the recurring fee until you cancel. Subscriptions renew automatically at the end of each billing period at the then-current rate.

Payment Processing

Payments are processed by third-party providers including Skool and Stripe. By making a purchase, you also agree to the terms of the applicable payment processor. We do not store full payment card details on our systems.

Cancellation

You can cancel your subscription at any time through your Skool account settings. Cancellation stops future billing but does not refund the current billing period unless the money-back guarantee below applies.

4. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on new memberships in The Mompreneur Club. If you are not satisfied within 30 days of your initial purchase, contact us at [email protected] to request a refund of that initial payment.

The guarantee applies only to your first paid period (the first month for monthly members, or the first annual term for annual members). It does not apply to renewal payments, second purchases, or any other product.

Refunds will be processed to your original payment method within a reasonable time after we receive your request.

5. License to Use Our Content

When you purchase a course, join the community, or download a lead magnet, we grant you a limited, personal, non-transferable, non-exclusive license to access and use that content for your own business and personal learning.

You may not:

Share, resell, or redistribute our content, courses, recordings, or materials.

Give your login credentials to anyone else or allow others to access paid content through your account.

Copy, reproduce, or republish our content on other platforms, websites, or in your own products.

Use our content to train artificial intelligence or machine learning models.

Use our content to create a competing product, course, or community.

We retain all intellectual property rights in our content. If you violate this section, we may terminate your access without a refund and pursue any other remedies available to us.

6. Content You Post in the Community

When you post content in The Mompreneur Club (including comments, replies, posts, questions, and shared materials), you keep ownership of your content. However, you grant us a worldwide, royalty-free license to use, display, reproduce, and distribute your content within the Services and for the purpose of operating and promoting them.

You are solely responsible for the content you post. By posting, you confirm that:

You own the content or have the right to share it.

Your content does not violate the rights of any third party.

Your content does not violate any law or these Terms.

7. Community Rules of Conduct

The Mompreneur Club is a supportive space for moms growing their businesses. To keep it that way, you agree not to:

Harass, bully, threaten, or discriminate against other members.

Post spam, unsolicited promotions, or pitch your offers to members in DMs without permission.

Share content that is hateful, sexually explicit, violent, or otherwise inappropriate.

Impersonate another person or misrepresent your affiliation with anyone.

Share confidential information shared by other members outside the community.

Attempt to gain unauthorized access to the community or other members' accounts.

Use the community to promote multi-level marketing schemes or get-rich-quick offers.

We reserve the right to remove content and remove members who violate these rules, at our sole discretion and without refund.

8. Results and Earnings Disclaimer

We share strategies, frameworks, and examples that have worked for us and our clients. Specific results mentioned on our website, in our marketing, or in our content are examples of what is possible, not guarantees of what you will achieve.

Your results depend on many factors, including your offer, audience, effort, skill, market conditions, and many other variables outside our control. We make no guarantee that you will earn any specific amount of money, get a specific number of clients, or achieve any specific business outcome.

Nothing we provide should be considered legal, financial, tax, medical, or other professional advice. Always consult a qualified professional for advice specific to your situation.

9. Third-Party Services and Tools

Our Services rely on third-party platforms including Skool, Stripe, email service providers, and others. We may also recommend tools (including AI tools such as Claude) in our content. We are not responsible for the availability, performance, terms, pricing, or policies of any third-party service. Your use of those services is governed by their own terms.

10. Intellectual Property

All content on our website and in our Services, including text, graphics, logos, images, course materials, frameworks, methods, and the look and feel of our brand, is owned by McCartney Marketing LLC or our licensors and is protected by copyright, trademark, and other laws.

"The Mompreneur Club" and any related logos, taglines, and branding are trademarks of McCartney Marketing LLC. You may not use them without our prior written permission.

11. Termination

You can stop using the Services at any time by canceling your subscription and discontinuing access.

We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms, our community rules, or applicable law, or if we discontinue any part of the Services. If we terminate your access for cause, you will not be entitled to a refund.

Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will continue to apply after termination.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Services at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, McCartney Marketing LLC and its owner, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Services.

Our total liability to you for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid us in the twelve (12) months before the event that gave rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless McCartney Marketing LLC and its owner, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Services; (b) your violation of these Terms; (c) your content; or (d) your violation of any third party's rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict of law principles.

Before filing any formal claim, you agree to first contact us at [email protected] and try to resolve the dispute informally. We will do the same.

Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New Hampshire, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. Material changes will be communicated through our website or by email when appropriate. Your continued use of the Services after changes take effect means you accept the updated Terms.

17. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services.

Severability. If any part of these Terms is found unenforceable, the rest will remain in effect.

No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our business.

Independent parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
